Framepoint Terms of Service

Thank you for choosing Framepoint ("Framepoint," "we," "our," or "us").

These Terms of Service ("Terms") govern your access to and use of the Framepoint mobile application and related services (collectively, the "Service").

By downloading, accessing, or using Framepoint, you agree to these Terms. If you do not agree, please discontinue use of the Service.

1. Our Service

Framepoint is a content creation platform designed to help businesses create professional marketing content using customizable templates, editing tools, photos, videos, branding assets, and export features.

Our goal is to provide a reliable, intuitive, and continuously improving experience. From time to time we may introduce new features, improve existing functionality, fix bugs, enhance performance, or make changes that improve the overall quality of the Service.

2. Using Framepoint

Framepoint grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service in accordance with these Terms.

You agree to use Framepoint responsibly and only for lawful purposes.

While using the Service, you agree not to:

  • interfere with the operation or security of the Service;
  • attempt to gain unauthorized access to Framepoint systems;
  • reverse engineer or attempt to extract the application's source code except where permitted by applicable law;
  • distribute malicious software or harmful code;
  • impersonate another individual or business; or
  • use the Service in a manner that violates applicable law.

3. Your Content

The content you create using Framepoint belongs to you.

This includes content such as:

  • photos;
  • videos;
  • logos;
  • branding assets;
  • business information;
  • text you enter; and
  • exported images and videos.

Framepoint does not claim ownership of your original content.

You are responsible for ensuring that you have the necessary rights, permissions, and licenses to use any media or other content that you upload, import, or create using the Service.

4. Templates and Application Content

Framepoint and its original software, templates, interface, graphics, branding, icons, and other application content are protected by intellectual property laws.

You may use Framepoint's templates to create your own content.

However, you may not copy, redistribute, sell, reverse engineer, or otherwise exploit the application itself except as permitted by these Terms or applicable law.

5. Anonymous Profiles

Framepoint currently operates using anonymous profiles rather than user-created accounts.

Anonymous profiles allow the Service to remember your editing workspace, branding information, provider media, and application preferences across sessions.

Because Framepoint does not currently require user accounts, uninstalling the application or clearing application data may permanently remove information associated with your anonymous profile.

6. Premium Features

Framepoint may offer optional premium features through paid subscriptions.

If premium subscriptions are available:

  • purchases made within the iOS application are processed using Apple's In-App Purchase system;
  • subscription pricing and billing information are presented before purchase; and
  • Apple manages billing, renewals, cancellations, and refunds in accordance with its own policies.

Access to premium features may change if your subscription expires or is cancelled.

7. Acceptable Use

We want Framepoint to remain a safe and professional platform for everyone.

You agree not to use Framepoint to create, upload, or distribute content that:

  • violates applicable law;
  • infringes another person's intellectual property rights;
  • contains malicious software or harmful code;
  • promotes unlawful activity;
  • is fraudulent or intentionally deceptive; or
  • violates the rights of another individual or organization.

If we reasonably believe the Service is being used in violation of these Terms, we may suspend or restrict access where appropriate.

8. Availability

We work hard to provide a reliable Service.

However, Framepoint may occasionally be unavailable due to software updates, maintenance, third-party service interruptions, technical issues, or circumstances beyond our reasonable control.

We do not guarantee uninterrupted or error-free operation of the Service.

9. Updates

We may release updates to improve functionality, security, compatibility, performance, or reliability.

Some updates may be required in order to continue using certain features of Framepoint.

10. Disclaimers

Framepoint is provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Although we strive to provide a high-quality experience, we cannot guarantee that the Service will always operate without interruption or that every feature will always function exactly as intended.

11. Limitation of Liability

To the fullest extent permitted by law, Framepoint shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Service.

Our total liability for claims relating to the Service will not exceed the amount you paid to use Framepoint during the twelve (12) months immediately preceding the claim.

If you have not paid to use Framepoint, our liability will be limited to the maximum extent permitted by applicable law.

12. Privacy

Your use of Framepoint is also governed by our Privacy Policy.

We encourage you to review the Privacy Policy to understand how information is collected, used, stored, and protected.

13. Changes to These Terms

We may update these Terms from time to time.

When material changes are made, we will update the Effective Date at the top of this document and, where appropriate, provide additional notice within the Service.

Your continued use of Framepoint after updated Terms become effective constitutes acceptance of the revised Terms.
